Kim Dotcom’s criminal attorney released a white paper today accusing the Obama administration of being in the pocket of the MPAA. It further claims that the White House is for sale, and in the pockets of big business. They state that they used dubious legal principles to take down the biggest file hosting website in what is now the biggest copyright case in the world.
Kim’s lawyers attacked links between Chris Dodd and Joe Biden, who are good friends. Chris Dodd, who is the CEO of the MPAA worked his relationship with Vice President Biden to assist the prosecution of Kim in exchange for large amounts of campaign money speculated the paper.
It also stated that what Megaupload did was not in any way illegal. What they called secondary copyright infringement is not illegal in the United States, and never has been. What they mean by this, is that they can’t actively police their millions of users, so they can’t be held criminally responsible for the few who upload copyrighted content.
The paper goes on to say that Megaupload actively responded to DMCA take down requests and gave copyright holders a huge say on what gets taken down on their website. In fact, copyright holders had the power to take down any offending file that they wanted to.
There wasn’t much new in the paper as far as legal defense goes, the only thing “new” in this is the attack on the Obama administration. They claim that the link between Dodd and Biden is not just a coincidence, but an outright attack on a legitimate company in favor of big business.
